LED Capstone reserves the right to make changes to its website, polices and the Terms and Conditions at any time.

All measurements on our website are approximate and subject to standard acceptable tolerance variation. All specifications are subject to change, due to continuing product improvements or development. All products are subject to design improvements and change. All products are subject to change without notice. Backorders: You will be notified of any products which are on backorder. It is our policy to charge you when your order ships, unless stated otherwise on our website.

Customs, Duties, Import Fees: We are not responsible for customs charges, duties, nor import fees imposed by foreign countries. LED Capstone also is not responsible for delays by airlines, customs officers, or shipping agents after your shipment leaves our warehouse.

Florida Sales Tax: LED Capstone is required to charge sales tax for any items shipped to any location within the State of Florida or picked up in Florida. If you are purchasing items for resale, please provide LED Capstone with a current Florida Resale Certificate and you will not be charged Florida sales tax.

Governing Law and Venue: All legal issues arising from or related to the use of LED Capstone’s website and all purchases made in our showroom and design center shall be construed in accordance with and determined by the laws of the State of Florida applicable to contracts entered into and performed within the State of Florida, without respect to its conflict of laws principles. By using the web site and purchases from our showroom and design center, user and clients agree that the exclusive forum for any claims or causes of action arising out of user's use of the Web Site shall be either any state court for or within Indian River County in the State of Florida and the United States District Court for the Southern District of Florida. User and client hereby irrevocably waive, to the fullest extent permitted by law, any objection which user and client may now or hereafter have to the laying of the venue of any such proceeding brought in such a court and any claim that any such proceeding brought in such a court has been brought in an inconvenient forum. If any provision of this Agreement is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of this Agreement, which shall remain in full force and effect. No waiver of any term of this Agreement shall be deemed a further or continuing waiver of such term or any other term.

Mistakes: In the unlikely event LED Capstone makes a mistake unintentionally, in a description of a product and/or pricing of a product, during editing, photographic, pricing, or typographical error on our website, we reserve the right to make corrections. LED Capstone reserves the right to refuse or cancel any orders placed for product listed at the incorrect price. LED Capstone reserves the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. In the event your credit card was charged for a purchase and your order was canceled, LED Capstone shall issue a credit back to your credit card for the amount of the canceled purchase.

Non-Returnable: Products with a broken seal, clearance items, close-outs, discontinued, and special order items are not returnable, unless a specific Written Agreement is in place between the purchaser and LED Capstone. If any of these items are found to be damaged or defective upon delivery, you must notify us, in writing, via e-mail to orders@ledcapstone.com, within 15 calendar days from shipping date. We will issue a replacement or a refund, at the discretion of LED Capstone. Any return received outside of 30 days from invoice date, will be disallowed.

Price and Payment: Purchaser agrees that all prices, unless stated otherwise on our website, are F.O.B. Vero Beach, Florida. Purchaser also agrees that all prices, unless stated otherwise on our website, are exclusive of any applicable taxes. Please note that all prices are subject to market conditions and therefore may change without prior notice. We gladly accept Discover, MasterCard, VISA, or American Express. Your credit card number, expiration date, verification code, and name (as it appears on the card) are required fields to place an order. For security reasons, the address entered in the "billing information" section of the checkout process must be your credit card billing address. Products shipped directly from the supplier/manufacturer are billed at the time of purchase and you may also incur sales tax if the supplier operates a business in your state.
